Non Negotiable Terms, Conditions & Policy by Luxox Furniture Pvt. Ltd. 

These Non-Negotiable Terms, Conditions & Policies (“Terms”) constitute a legally binding agreement between Luxox Furniture Private Limited (“Luxox”, “Seller”, “We”, “Us”) and the Customer / Buyer (“You”). 

*Section 74 of the Indian Contract Act, 1872 & Sale of Goods Act, 1930*

By placing an order, making payment (full or partial), approving a quotation or proforma invoice, accepting delivery, or engaging with Luxox in any manner, the Customer expressly confirms that they have read, understood, and unconditionally accepted these Terms in their entirety.

These Terms override all verbal discussions, emails, WhatsApp conversations, or representations, unless expressly agreed in writing by authorized management of Luxox.

Order - Payment - Dispatch - Shipping

# Extra Glass, Cushion, Throw Cushion, Artifacts shall be charged extra unless otherwise mention on poforma Invoice / Quotation

 # All order shall be delivered/ dispatched after full and final payment reconciled to our accounts. No goods shall be released for loading and dispatch until and unless final payment is reflected in our accounts.The goods remain the seller's property until full discharge of all obligations and payment of full price by the customer.# Part payment and part shipment shall not be allowed. Notwithstanding part shipment in any such condition will be allowed only after full and final payment of complete invoice value consisting all the products which are ordered by the buyer at binging.

 # It is mandatory to obtain gate pass and Challan before taking direct delivery from factory. Gate pass will be only issued after clearance from accounts.

 # Cash on delivery terms.

Full amount to paid at the time of delivery before hand over prior to open the Package. COD charges Rs 500/- extra per order.

You pay = invoice amount + COD charges
1. Available only for order Value less then Rs. 5000/-
2. Available for Selected products (If mentioned in product description)
3. Available for Delhi NCR only

# Delivery not facilitated by customer within the time limit set by different carrier shall be stored in carrier warehouse and all the subsequent charges shall be borne by the buyer.

# Please check if delivery address is eligible from listed pin code check list from our shipping partners. If in case the pin-code is not included then the Carrier shall charge extra ODA (Out of delivery area charge) which must be borne by buyer and paid in in advance either to Shipping company or Luxox as required during delivery/dispatch.

 It is mandatory for buyer to check ODA (Out of delivery area charge) charges from the link provided below and Luxox Furniture Pvt Ltd management is not liable or bound to check.

 # Any delay in pickup, payment and rescheduling of order beyond 30 days of readiness of ordered product shall attract 4% Interest on balance payment on Monthly basis & storage charges Rs. 500/- Per Month / Per CBM & Repacking, Refinishing Charges as per actual. Ordered shall stand Cancel & advance shall be forfeited for any delay beyond 180 days.

# The cost of Insurance shall be borne by that party who will arrange and pay for shipping as per deal.

# An email confirmation will be required if the buyer changes delivery address/ pin-code, other than mentioned during order and whatever extra charges arises shall be paid by buyer. 

If the customer requests special packing or a special shipping mode the extra expenses arising will be invoiced separately.

# All State, Central, Union territories Tax, Octroi, Custom, Excise TAX, Entry/Exit Charges applicable will be extra shall be paid by Buyer. Buyer must provide any Entry/Exit permission documents required for  Spacial high security zone, Society, Apartment, Housing complex.

 # Any other shipping, extra packing or other charges such as handling cost etc. should be paid full and final before dispatch.

# If the customer requests special packing or a special shipping mode the extra expenses arising will be invoiced separately.

Customisation

 # Select colour of cushion fabric from https://luxox.shop/pages/color-and-weaving-patterns & https://luxox.shop/pages/wicker-options. In case of no Selection/ preference is provided or Colour is not available from fabric vendor we shall select from closest available option. In few cases cushion colour might not be available in stock as per Image published on website.

 # Colours of wicker, Braid, Wood and fabric are subjected to change up-to 10 to 20 % from lot to lot as it is hand made product.

# Minor size and design are subjected to change without notice as we continuously improve our furniture and change to achieve better design, comfort & handling.

# Please select wicker, braid, fabric & other options and add to order notes. You may also mail us your preference within 72 hours of your order. Premium charges shall apply in case special weaving/customisation options selected. In case no option Is provided by buyer, furniture will be made as per image (Colour combination) provided in Website.

Quality & Finish

# Quality claims in respect of the goods ordered may be made only to the extent that they can be made equitably or in accordance with ordinary trade usage in respect of goods in the same price range as the goods ordered. Wood surfaces are subject to colour and grain variations in accordance with ordinary trade usage and acceptable to the customer. Woden surface may crack or deface when exposed to direct sun & rain.

Warranty

# Buyer should read carefully and follow usage instruction failing to which the warranty shall be Void and cancelled.

# If buyer failed to make payment and default any payment the the warranty will be cancelled and void.

Copyright & Design

# Luxox retains all title to and copyright in illustrations, drawings, sketches, other documents and samples for items made to order. They shall not be passed on to a third party without the consent of Luxox. Luxox Plus-assumes no responsibility for defects in items made to order that are based on the customer’s information, instructions or design specifications and design documents.

Timeline

# Kindly note all order time line will be considered for production under two circumstances.

  1. From the date of receipt of agreed amount reconciled to our account.
  2. Only after final approval of Customisation (Fabric, wicker, braid, wood and Size etc.)

Any delay in payment advance or customisation in-put by buyer will make all offer and timeline commitment void and shall be considered from the date upon fulfilment of both the aforesaid mentioned conditions. Ordered timeline is 4 to 6 weeks (unless other wise committed by sales management team) (Excluding Non business days & festival leaves)

# Change in order, fabric, colour or other alteration may require extra production time. Also note any change in size, shape, design or colour shall attract extra cost. Extra time and written acceptations notification by email or any other mode is require to proceed with changes/ alteration. Once the selection of customisation is done by buyer, any change / alteration shall not be accepted by management. Only first selection made by buyer shall be considered.

#Dispatch dates are estimated and tentative and may sometime extend up to 4 to 6 weeks over and above given time line. All hand made/ hand woven furniture may take extra time depending upon availability of resource, labour, holidays, quality & finishing testing etc.

# Any Delay due to unavoidable situation (extreme cold, extreme summer, extreme rains, war, civil war, riots, flood, fire, earth quake, volcanic eruption, natural disasters, pandemic, epidemic, lack of raw material, shortage of skilled labour, change in government rules, sealing, licensing, lock down, Political Unrest, Emergency, Pollution Ban/Restriction, Mechanical Breakdown, Accident or any other unavoidable and undesired conditions which effects Business directly or indirectly, Etc) is considered as exceptional circumstances and the order timeline is subjected to be rescheduled. Disruptions to the seller's or its suppliers business for which the seller is not responsible in particular strikes and lockouts and instances of force majeure based on an unforeseeable event arising without fault, shall extend the period accordingly.

Claims - Cancelation - Refund - Replacement 

 

# For any Claims buyer shall take pictures of damages of product and packing before opening and shall report it to customer care email id of shipping company and cc to care@luxox.com within 24 hours from the receipt of Shipment. Damaged goods shall be received only after mentioning, “damaged during transit” on acknowledgement slip and POD. All claims are subjected to be settled by the insurance company. Buyer should provide salvage, documents and all evidence time to time required by insurance company.

# Product which is currently not available in stock will be made especially and will not be subject to cancellation and refund once the production starts.

# Ordered product once sold/ Delivered shall not be returned, exchanged or refunded. (Replacement will be done if the product is beyond the scope of repairing.)

 # Cancellation of any particular Item from order having multiple products shall not be possible once production is started and raw-material is ordered.

# Any discount or free shipping offered on a packaged/project deal which has multiple product shall stand void-ab-initio if the quantity of a specific item or any particular design is cancelled. Buyer shall bear MRP cost of all the products and Discount shall be withdrawn.

 # Any product bought during promotional/Sale schemes such as  (sale, free shipping, discounted, prioritised ) are not subjected to cancellation or refund.

 # Please note any customisation in order will disqualify easy refund policy. i.e  customised orders are not subjected to refund.

# Ordered products not picked up till 90 days of completion shall attract an Interest of 15% per annum on pro rata basis from the date of scheduled dispatch. A storage charges of Minimum 10% of Invoice value and maximum Rs. 5000 per CBM shall be charged per annum.

# Any balance payment of order not made, and good not picked up till 180 shall be cancelled and advance shall be forfeited. If after 180 days buyer neither pays more expenses his/her interest of picking up goods .The Luxox has right to sell the goods by rectifying goods to another client.  The luxox has right to ask buyer for balance amount from the client through amicable or legal means. Advance payment received shall be taken as all terms and conditions accepted by buyers.

# If, upon expiry of the agreed time for delivery, the customer remains silent or expressly refuses to pay and/or take delivery without legal ground, the seller’s claim to performance of the contract shall subsist. Instead of that it can cancel the contract and/or demand compensation in lieu of performance upto 25% of the purchase price.

# All dispatch and production related query will be entertained during business hours 10:00 AM to 6:00 PM on 7677622997 through call or whatsapp or email:- orders@luxox.com. No query of sales and technical shall be entertained on this number. Any call beyond the business hour / business days will be not be entertained. (Weekly off Monday)

 

Delivery & Responsibility Terms

# Scope of Delivery

Our responsibility is strictly limited to delivery of goods at the ground floor / building entrance only. Any movement of material beyond the ground floor, including but not limited to upper floors, basements, staircases, lifts, or internal premises, is not included in our scope of work, unless expressly agreed in writing for free delivery.

# Installation & Placement

Installation, placement, unpacking, or fixing of products is not included in the scope of Luxox Furniture Pvt. Ltd. and shall be the sole responsibility of the customer, unless a written request is accepted by Luxox.

  • Swing, other furniture, fixture, fencing, installation is not included.
  • Installation videos and remote assistance shall be provided free of cost (FOC).
  • Swing rope will be provided only for a maximum ceiling height of 10 feet from floor level.

# Beyond Ground Floor Handling

Transportation of goods beyond the ground floor, whether by manual lifting, lift, staircase, crane, or any other means, shall be entirely at the customer’s risk, responsibility, and cost. Luxox does not provide manpower, equipment, or supervision for such handling.

# Lift & Access Constraints

If the material does not fit into the lift, or if the lift is unavailable, non-operational, restricted, or denied by society/building management, Luxox shall not be responsible for manual shifting or arranging alternative delivery methods.

# Refusal of Ground Floor Delivery

If the customer refuses to accept delivery at the ground floor for any reason whatsoever, the shipment shall be returned to the original destination.

# Order Cancellation & Advance Forfeiture

In case of refusal or non-acceptance of delivery, the order shall be deemed cancelled, and any advance or part payment made shall stand forfeited. No refund, adjustment, or credit note shall be issued.

# Re-shipment Terms

Any request for re-shipment or re-delivery shall be:

  • Subject to prior approval by Luxox
  • At the sole discretion of the seller
  • At the entire risk, responsibility, and cost of the customer
  • Subject to revised delivery timelines and additional charges

# Damage & Liability

Upon delivery at the ground floor, all risks including damage, theft, or mishandling shall immediately transfer to the customer. Luxox shall not be liable for any loss or damage occurring thereafter.

Delivery Delays, Local Restrictions & Risk Allocation

Delivery timelines may be affected due to government regulations, society no-entry rules, restricted delivery hours, traffic or municipal restrictions, or special zone permissions.

In the event that the delivery vehicle is halted, parked, or detained in an open or unsecured area due to non-availability of required permissions or access restrictions, it shall be the sole responsibility of the customer to arrange supervision, security, and protection of the goods. Any loss, theft, pilferage, or damage arising in such circumstances shall be entirely at the customer’s risk and cost, and Luxox shall bear no liability whatsoever.

Luxox shall not be responsible for any additional charges arising due to waiting time, detention, rescheduling, re-routing, or access delays.

All permissions, approvals, gate passes, society NOCs, municipal clearances, or special zone entry authorizations required for vehicle movement or delivery must be obtained and provided by the customer in advance of shipment. Failure to do so shall not constitute a breach or delay on the part of Luxox.

# Large Shipments

For large shipments, Luxox’s responsibility is limited to loading of goods at the original factory location. Luxox shall have no responsibility for unloading, unpacking, installation, or placement at the destination and will not provide labour for the same.

Transportation Terms

  • Transportation facilitated by Luxox Furniture Pvt. Ltd. shall be prepaid only.
  • Booking of third-party transport applications or services such as Porter, WheelsEye, or similar platforms shall be solely the responsibility of the customer. Luxox shall have no obligation or liability to book, manage, or coordinate such services.
  • If, at the customer’s request, any Luxox executive assists only in identifying or suggesting a transporter, such assistance shall be purely facilitative, and all transportation charges must be paid in advance by the customer.
  • Any additional transportation costs arising due to delay, rescheduling, waiting time, detention, route restrictions, access limitations, or any other reason whatsoever shall be entirely borne by the customer.
  • Luxox shall not be responsible for any loss, delay, damage, or dispute arising during third-party transportation arranged or paid for by the customer.

 * All disputes shall be subject exclusively to the jurisdiction of Courts at Delhi, India.
Jurisdiction is non-transferable and exclusive.
